Case Details

The sole role of the Executive Branch of Government is to faithfully execute the laws of the United States — including the Refugee Act of 1980 which requires people to be physically present in the United States in order to apply for asylum. Is the Executive Branch acting in bad faith when it manipulates courts and removal proceedings to cancel lawfully filed asylum applications and detain asylum-seekers without due process?

On June 5, 2025, federal immigration enforcement agents arrested Y-Z-L-H-, a young migrant who lawfully applied for asylum in the United States.

Y-Z-L-H’s attorneys filed a petition for a Writ of Habeas Corpus in the United States District Court for Oregon alleging that ICE’s arrest and detention violates the Due Process Clause and the Administrative Procedure Act.

No person should be subjected to the arbitrary and capricious whims of the Executive Branch.
