Petitioner Gene Fritson fled Haiti and came to the United States in January 2023 to seek protection. He was paroled into the country for the purpose of seeking asylum. Since that time, Mr. Fritson conscientiously pursued his immigration case and built his life in the United States. Nevertheless, on in December 2025, while doing his job as a truck driver, ICE arrested and re-detained Mr. Friston, despite the fact that there were no changes in Mr. Fritson’s individual circumstances that could justify his re-detention. Mr. Fritson is now detained at the notoriously harmful Torrance County Detention Facility in Estancia, New Mexico.

On March 4, 2026, Mr. Fritson filed a petition for writ of habeas corpus to seek his freedom from unlawful custody on the grounds that his re-detention violates immigration law, the Administrative Procedure Act, and the Due Process Clause of the United States Constitution. Mr. Fritson also filed a motion for a temporary restraining order to seek his immediate release.
